How to obtain Model Approval Certificate?

Introduction:

The process of Model Approval is quite complicated and a little tedious. Every manufacturer/importer shall obtain the model approval license of each product (weight or measure instruments) before the commencement of its sale or distribution.

Section 22 of the Legal Metrology Act, 2009:

According to section 22 of the Legal Metrology Act, 2009, every person should seek approval of every model before manufacturing or importing any weight or measure, along with payment of a fee to the authority as may be prescribed.
However, in certain cases approval of model may not be required like iron, brass, bullion or carat weight or any beam scale, length measures (not being measuring tapes) which are ordinarily used in retail trade for measuring textiles or timber, capacity measures not exceeding twenty liters in capacity, which are ordinarily used in retail trade for measuring kerosene, milk or potable liquors.
Besides, if the prescribed authority is satisfied that the model of any weight or measure which has been approved in any country other than India as per the standards established by or under this Act, may approve such model without any test or post such test as it may deem fit.

Rule 19 of the Legal Metrology (Approval of Models) Rules, 2011

The Rule19 of the Legal Metrology (Approval of Models) Rules, 2011 states fees for testing of a model of weight or measure
The steps to deposit fees for testing of a model of weight or measure are as follows:
* Firstly, at the time of applying under Rule 5, the applicant shall deposit fees in the form of a demand draft in favor of the laboratory or through an online payment. Fees for various kinds of products/models are as follows:
(i) The amount of fees required for testing a mechanical type model for weight or measure or weighing or measuring instrument is Rupees ten thousand only.
(ii) The amount of fees required fees for testing of digital or electronic type models of weights or measures or weighing or measuring instruments that are intended to be manufactured or * imported for transaction or protection are rupees twenty-five thousand only.
Secondly, the applicant should deposit half of the testing fees as specified in sub-rule (1) for testing of the substitute material.

Conclusion:

It is mandatory to obtain a certificate of Model Approval. The above-mentioned certificate is technical, therefore, one should seek professional assistance to obtain them.
