Legal Metrology Registration

Whenever importing any pre-packaged goods or commodities into India, importers must first get an LMPC Registration Certificate. Rule 27 of the Department of Consumer Affairs' legal Metrology Packaged Commodity rules. The registration must be completed within 90 days after the beginning of the import.

Features of Legal Metrology Act

(i) Legal Metrology is the application of legal requirements
to measurements and measuring instruments.

(ii) It ensure public guarantee from the point of view of security and accuracy of the weighments and measurements.

Act's Highlights

The government has implemented the following laws to ensure uniform enforcement of regulations pertaining to Legal Metrology across the country: (1) The Meghalaya Legal Metrology (Enforcement) Rules, 2011, (2) The Legal Metrology (Packaged Commodities) Rules, 2011, (3) The Legal Metrology (General) Rules, 2011, and (4) The Legal Metrology Act, 2009.

 

Legislation of Act

The Legal Metrology Act, 2009: The Act received the assent of the President on the 13th January, 2010 and came into force with effect from 1st April, 2011. Specific Provisions under the Act are:

  •  The Legal Metrology Act, 2009 is a single Act covering the provisions of the Standards of Weights and Measures Act, 1976 and Standards of Weights and Measures (Enforcement) Act, 1985
  • The Act is having only 57 Sections.
  • No registration of users of weights and measures is required.
  • Registration for export of weights and measures is not required.
  • The penalty provisions of different offences have been increased.
  • Standardization of units of weights and measures based on metric system.
  • Declarations on pre-packaged commodities.
  • Approval of model of weight or measure before manufacturing/ import.
  • Prohibition on manufacture, repair or sale of weight or measure without license.
  • Verification and stamping of weight or measure.
  • Only one nominated Director of the company will be responsible for the offences done by the company under the Legal Metrology Act.
  • Provision of Government Approved Test Centre has been introduced.

Function of Legal Metrology

 (i) A transparent and effective legal metrology system instils trust in trade, industry, and consumers, and creates a pleasant business environment by contributing to the country's economy by boosting revenue in many industries. (ii) Assisting in the reduction of revenue losses in the coal, mining, industries, petroleum, and railway industries.

(iii) Loss and wastage in the infrastructure sector are reduced.

The act not apply in certain cases –the provisions of the Act, in sofar so they relate to verification and stamping of weights and measures, shall not apply to any weight or measure used for scientific investigation or for research.
