A person whether a company, firm, department, society, office working as a manufacturer, importer or a packer needs to have a Legal Metrology Registration as provided by the Indian law under the Legal Metrology Act and for conducting their professional affairs should have a Legal Metrology Registration. Under Section 19 of the Legal Metrology Act, 2009 dealing with the registration for importer of weight or measure that no person shall import any weight or measure if such person is not registered with the Director in the prescribed manner and on payment of prescribed fees. Failing which, Section 38 of the Legal Metrology Act deals with penalty provisions for non-registration by importer of weight or measure that whoever imports any weight or measure without being registered under this Act shall be punished with fine up to Rs. 25,000/- and for the second and subsequent offence with imprisonment for a term which may extend to six months, or with fine, or with both. Also, under Rule 15 of the Legal Metrology (General) Rules, 2011, every manufacturer or dealer of weight or measure who intends to import any weight or measure shall apply to the Director in the prescribed manner, through the Controller of the State in which he carries on such business for registration of his name as importer in the form specified in Tenth Schedule, together with the prescribed fee at least one month before the date on which import is proposed to be made. The Legal Metrology Registration of a person as an importer is valid for a period of five years from the date of its registration. On the expiry of such registration a renewal application for legal metrology registration by the importer should be made to the Director for the renewal of the registration under legal metrology.
