The Legal Metrology Act was established to enforce standards of weight & measure of other goods. This is necessary for the items that are sold or distributed to measure and regulate trade and commerce in weight & measure. As we are all aware that in today’s world measurement is a part of our daily lives. Manufacturing License Under Section 23 of Legal Metrology
A Manufacturing License under Section 23 of the Legal Metrology Act, 2009, is required for any person or company that wants to manufacture weights, measures, or related instruments in India.
- This license ensures that all manufactured products meet the accuracy, safety, and labeling standards set by the Legal Metrology Department.
- Without this license, no manufacturer can legally produce or sell such items.
- The license is issued by the Legal Metrology Department after proper application, document verification, and inspection of the manufacturing unit.n
It is generally valid for one year and can be renewed up to five years.
Weight and Measurement License for Manufacturer, Importer, and Repairer
Every person who is dealing as a manufacturer, importer, repairer, or dealer has to take a license to sell, manufacture, import, or repair such a commodity. Every manufacturer has to apply to the Controller Legal Metrology or any other officer as may be authorized by him in this regard. The application has to be filed in an appropriate set of forms prescribed under
Schedule II-A
which says that the manufacturer does not need to take the license to repair the weight or measure which is manufactured by him and the same is used in a state other than the state where he has manufactured such a commodity, but the manufacturer must inform the concerned Legal Metrology officer about the repairing of the commodity.
Schedule I of the Legal Metrology Act
The non-tribal paper, dealer, and all manufacturers who operate their business in the VI scheduled areas of Meghalaya have to apply for the trading license from their respective autonomous District Council of the state of Meghalaya.
Schedule II-b of the Legal Metrology Act
Under these schedule II-B of the Act, the manufacturer, dealer, or repair of weight and measure have to make a renewal application to the Controller Legal Metrology or any other officer prescribed by him in this regard for the renewal of license, and the application shall be made within 30 days before the expiry of the validity of the license.
Schedule III of the Legal Metrology Act
Under Schedule III of the act, the appropriate form is prescribed for the license to any repairer, dealer, or manufacturer of the weight or measure.
The license shall be issued by the controller or any other officer authorized by him.
Schedule IV of Legal Metrology Act
The fee for the license of manufacturing, repairing, or importing the weight or measure shall be made in a prescribed amount specified in Schedule IV of the Act.
Any alteration which is likely to be made in the license, or in case of the issuance of a duplicate license, the fee shall be 1/2 of the license fee as given under Schedule IV of the Act. Renewal of a license can be done within three months from the date of expiry of the license. Where the controller permits the applicant to make an application for renewal of the license, the additional fee specified in Schedule IV, Shelby is borne by the applicant.
Schedule V of the Legal Metrology Act
The Controller or Director must maintain a register of licensed manufacturers, repairers, and dealers, as prescribed under Schedule V of the Act.
No manufacturer, repairer, or dealer is allowed to resell or transfer the license to any other person under the act.
Schedule VI of Legal Metrology Act
Under Schedule VI, every repairer who is getting the license to repair the commodity under the act is bound to furnish a security deposit for each license to the state government.
In compliance with the Terms and Conditions of the license, every repairer, dealer, or manufacturer shall maintain the equipment, registers, tools, workshop, etc. of the weight or measure.
How to Apply for a Legal Metrology Manufacturer License?
Every applicant shall submit the prescribed documents and information to the controller or director, and the offices of the legal metrology in a prescribed form (Form LM-1). To apply for the Legal Metrology manufacturer license in India, you must follow this process:
- Application Process – Anyone who wants to get a Repairer License for weights and measures can apply online on the Legal Metrology Department’s portal. The form is available through the Nivesh Mitra portal (niveshmitra.up.nic.in). First, you need to register there and then fill out the license application.
- Initial Scrutiny – After submission, the application first goes to the District Nodal Officer. Based on the firm’s address, the officer forwards it to the Local Senior Inspector/Inspector (Legal Metrology Officer – LMO).
- Correction of Errors – If there are mistakes or missing details, the LMO raises a query online. The applicant can log in and correct or upload the required details/documents online.
- Inspection by LMO – Once the application looks complete, the LMO sets a date for inspection. The LMO visits the applicant’s premises, checks the documents, and prepares an inspection report with recommendations. At the time of inspection, the applicant must show a signed copy of the filled application and self-attested copies of all uploaded documents.
- Committee Evaluation – The Assistant Controller (Licensing Authority) reviews the LMO’s report and documents. If the case looks suitable, the Assistant Controller may form a 3-Member Committee to test and evaluate the applicant’s ability to repair weights and measures. The committee’s report is sent back to the Assistant Controller, who may also forward it to the Controller (Licensing Authority) if it’s a state-level license.
- License Fee Payment – If approved, the applicant is asked to pay the license fee of ₹100 online through the Nivesh Mitra portal.
- Grant of License – After fee payment, the Assistant Controller/Controller issues the license. The license is digitally signed and can be downloaded by the applicant from the portal.
Documents Required for License of Repairing Weight and Measure
Every applicant who is a repairer has to apply for the prescribed form (Form-LR-1) along with the following documents for the registration of the manufacturer:
- Photographs, Identity, and Address proof of the applicant/partners.
- Proof of the Date of Birth of the applicant/partners.
- Ownership or tenancy document of the proposed premises.
- Partnership deed, in case of partnership firms.
- Document regarding the qualification, in the case of electronic weighing machines.
- Experience certificate.
- List of Machinery and tools.
- Affidavit to state that the applicant would adhere to the Legal provisions and the directions issued by the Controller.
- Affidavit to state that the applicant had neither been punished by any Court nor is any criminal proceeding pending in any court.
- Registration document of factory/shop/establishment/municipal trade license, as the case may be.
- Copy of GST Registration.
- Copy of PAN.
What is the Validity of the Manufacturer’s License?
The Legal Metrology license for a manufacturer, dealer, or repairer is valid for at least one year. After that, it can be renewed every year, and the renewal may be allowed for up to five years at a time, depending on the rules and prescribed government fee.
How to Renew a Manufacturing License under Legal Metrology?
To renew a manufacturing license under Legal Metrology, the license holder must apply to the Controller of Legal Metrology or the concerned State Legal Metrology Department before the license expiry. The renewal process is as follows:
- Application Form – Submit the prescribed application form for renewal (usually at least 30 days before the license expires).
- Required Documents – Attach necessary documents such as the existing license copy, proof of business premises, identity proof, and fee payment receipt.
