BIS Certification And Legal Metrology for Business

BIS stands for “Bureau of Indian Standards”. It is a national standard body of India under the department of the followings:

  1. Consumer affairs,
  2. The ministry of corporate affairs,
  3. food and public distribution, and
  4. Legal Metrology.

The Bureau of Indian Standards is established by the Bureau of Indian Standards Act 2016, which came into force on October 12th, 2017.

It was established for the harmonious development of the activities of standardization, marking, and quality certification of goods and formats to which they are connected.

Legal Metrology & BIS Certificate

  1. The BIS certificate enables us to offer a third-party guarantee of safety, reliability, and quality of products to the customers and is mainly required for imported items. This certificate is required by the Indian government for numerous items. A Bureau of Indian Standards (BIS) certificate is a process of demonstrating the quality of a product by brand and manufacturer.
  2. It ensures that the product is safe and credible for the consumer by the way of the legal metrology act in 2009 and the BIS act in 2016 and the Consumer Protection Act 2019. The main purpose is to enable consumers to feel empowered and secure to make the confirmed choices, and equitable and consistent outcomes, ensure fair practice for consumers and facilitate timely and effective grievance redress.
  3. The main purpose of the Legal Metrology and BIS certification is to understand the problems faced by the industry, particularly by MSME (Micro, Small and Medium Enterprises) startups and small enterprises. At various points, the government has taken suggestions for building a strong system that encourages and better adoption of Indian standards across products and services.
  4. Several workshops have been conducted by the government on making and focusing on Indian standards to attain global standards in all spheres to ensure their achievement in a better way. The workshop, which is being held at headquarters, has a first focus on various aspects of standards formulation, the conformity assessment process, and the requirements for testing.
  5. To promote ease of doing business, the government is facilitating simplification of the process of compliance that is required to be completed by the applicant to get the certificate of Legal Metrology and BIS.
  6. On various occasions, the central government has also raised the issue of the decriminalization of the legal metrology provisions so that it will be quite helpful for business man to run their business smoothly and properly without putting any unnecessary tension on their heads.
  7. To run the market, both sides of the coin are important, such as maintaining and securing the interest of the consumer as well as ensuring the business is properly and comfortably run and the ease of doing the business. Import and export of weights and measurements can be done only after complying with the provision of the act.
  8. Mr. Piyush Gupta, the union minister of consumer affairs and food and public distributions, railways, and commerce and industry addressed the workshop and ensured that the proper end zone will be given to the businesses and all small vendors so that they can run their business without any unnecessary hurdles, but by keeping the interests of the turn super safe and secure.
  9. The workshop on easing compliance for certification was organized on March 3rd, 2021 by the department of promotion of industry and intergrade along with the department of consumer affairs, which also includes the legal metrology department in itself and the Bureau of Indian Standards.
  10. The workshop which was held at headquarters was focused on various aspects of standards formulation, conformity assessment process, and requirement of testing.

Application for LMPC registration of importer

  1. The application for registration of an importer under rule 27 of legal metrology packaged commodities 2011 has to be filled out by the applicant who is an importer along with the mandatory documents attached with it.
  2. The license of trade, manufacture, factory, a certificate from MCD, NDMC, DDA, etc. is required to be submitted by the importer while filling out the application form.
  3. If the MCD license is not available to the applicant, then he may take the undertaking in the form of an affidavit to be submitted that
    • the business premises are not located in a non-conforming area, or
    • are not likely to be sealed by the MCD, or
    • relocated.
  4. The next document which has to be attached by the applicant should be the residential address proof of the director, partner, or proprietor, like their voter ID card, passport etc.
  5. GST, or sales tax registration should be attached along with the application.
  6. The packing material, slip, sticker, or label which is being pasted on the package should be attached by the applicant along with the application
  7. In the case of the company applicant, required documents would be the memorandum of association, and in the case of the partnership firm the applicant needs to attach the partnership deed.
  8. If the applicant is an importer, he needs to attach the import export code of himself.
  9. Passport-size photographs of all the directors, partners, or proprietors.

What should be the original document submitted by the applicant?

The original document that the applicant needs to submit with this application is given below:

  1. Proof of commercial area, and
  2. Receipt of offenses for which he is charged and whether they are compounded.

What is the procedure for approval of LMPC certificate for an importer?

  1. The applicant submits the application along with all the required documents and by depositing the fee, the concerned legal metrology officer of the concerned state and zone visits the premises of the applicant for inspection. List of documents for renewal of LMPC License.
  2. If the legal metrology officer finds everything as per the guidelines of the department, it may grant the LMPC license and LMPC registration by competent authority through the concerned zonal officer to the applicant.
  3. After completing the above-mentioned procedure, the competent authority, after scrutinizing, grants its approval to the applicant to import a commodity into the country.
  4. On the grant of a license, an automatic SMS alert and e-mail are sent to the applicant at its registered mobile number and e-mail address.
  5. An applicant can get the printed license and LMPC registration certificate digitally signed by the competent authority through online mode.

The Process to apply for BIS certification

An applicant can apply for BIS certification through the online mode by following the certain steps given below:

  1. Applicants need to fill out the application and attach all the required documents. Thereafter, during scrutiny of applications and documents, the BIS officials will conduct an inspection process of products along with the industry or factory.
  2. Initially, the applicant has to submit a report of the samples already tested and approved by BIS as per Indian standards.
  3. The applicant has to submit an application and pay for certificate costs along with all the required documents.
  4. After the inspection is completed and verified and approved according to the commended standards, the certificate is granted by the BIS within 60 to 65 days of the application being submitted and the inspection is completed.
